But businesses and schools will have changed their clocks so you wont be arriving anywhere on time unless and until you do. If you live in the U.S. where DST is observed, set your clocks ahead by one hour when DST begins, and back one hour when DST ends. People With Diabetes or Who Take Medications on a Time Schedule People with diabetes who take insulin shots or who use insulin pumps and other automated insulin delivery devices should change their pump clocks during the day. Changing medical device clock settings on devices such as an OmniPod during the night can affect basal settings and cause blood sugars to go too high or too low. If you take medications or insulin on a time schedule, talk with your doctor about how to safely change your clock so that you dont experience any possible side effects when DST changes occur. Your job as a candidate is to explain what in your past has prepared you to and demonstrates that you will do the job well to say here are the reasons I would excel at this job. Thats what it means to apply for a job youre saying heres why Id be the right fit.And everyone is basically agreed that this is the nature of a resume its designed to show what you bring to t he table. No one expects it to provide details of irrelevant coursework, or the project you worked on that almost ruined your company, or the fact that you were planning to go into the priesthood before you switched to medicine. (In fact, youd be judged negatively for including those first two youd be seen as someone who couldnt identify what is and isnt appropriate information.)And Im not sure where Randy is coming from with this concept of an employers legitimate right to know everything in your past. Employers have a legitimate right to expect that youre not lying (and an obligation to do their own due diligence on you, in the form of reference checks, etc.), but they dont have any special right to receive every detail about your education and work history on a silver platter, unless you choose to base your candidacy on those.Overall, I think his response reflects a slightly off-base understanding of what we, as a society, have agreed a resume is and even what employers want/ex pect from a resume. (Which is a reason that I wish non-workplace advice columnists wouldnt venture into workplace advice. It often results in weirdness.)

What I said and what I actually meant were different. After several months, I found ways to be more truthful without increasing the legal risk to the company.I began telling candidates the truth when I knew they were not getting hired. Many times, I knew a candidate was not getting the offer even before he or she finished the first round of interviews. In those situations, I told the candidates that we would not extend offers, and I was as specific as possible with my reasons why. For example, I once told a manufacturing engineer he was not getting an offer because he didnt have the level of required expertise in a particular set of technologies. He wasnt surprised, a nd he gave me the name of a colleague who was an expert in that area. We ended up hiring the person he recommended and we stayed in touch with the original candidate, hoping to find a position suitable for his talents. Its remarkable how people react when we treat each other as the peers we really are.Searching for work can be frustrating, yet the most maddening part is being lied to and having your email and voice messages ignored by recruiters, hiring managers, HR, and others.Job seekers (and we are all job seekers at many points in our careers) can create relief from the madness by analyzing a companys actions to separate the truth from the lies. It’s a delicate dance. Too late, and you’ve wasted a lot of time for a job that can’t support your obligations. Too early, and the question looks presumptuous.That’s the thorny patch that, Taylor Byrnes, a woman in Winnipeg, fell into this week. She asked about pay after her first interview, at which point the company representative, offended, cancelled her second interview.Byrnes tweeted about the experience, and it became a viral sensation, capturing the frustration of many job candidates who have trouble with salary negotiations.Here’s what happened.After an initial phone interview at SkipTheDishes, an online food delivery service that operates in Canada and the U.S., Byrnes had decided to email human resources about benefits and her potential salary  It was here where things went awry for Byrnes.Your priorities about pay “are not in sync with those of SkipTheDishes”Byrnes emailed SkipTheDishes, “how much do y ou think I’ll be getting paid an hour? Benefits will also be included, right?”She didn’t get the answer she wanted.In her reply to Byrnes, Victoria Karras, a talent acquisition coordinator for the company, cancelled the next interview, saying, “your questions reveal that your priorities are not in sync with those of SkipTheDishes.”In a follow-up email to Byrnes, Karras expanded on what exactly those priorities were: “Our corporate culture may be unique in this way, but it is paramount that staff display intrinsic motivation and are proven self-starters. For these reasons, questions about compensation and benefits at such an early stage is a concern related to organizational fit.”Some on Twitter followed  Byrnes’ call to boycott SkipTheDishes, believing  that asking about benefits was the sign of a motivated person. To count an interviewer  out for asking about pay was a red flag about the company’s labor practices, they argued.SkipTheDishes apologizes, offers Byrne s that second interviewAfter Byrnes’ experience went viral, SkipTheDishes co-founder Joshua Simair wrote a statement explaining how the company had been wrong.“We are very disappointed in how it was handled. We do share a compensation package prior to hiring. As soon as we became aware of it on Monday, we reached out to Taylor to apologize for the email and reschedule her interview,” he said, adding that staff would receive “additional training.”How SkipTheDishes could’ve handled this betterThere are takeaways for job seekers and employers with this story.For companies and hiring managers: don’t treat pay as a frivolous question. It’s a core part of why people work. SkipTheDishes should have reframed their tone. If Karras  really felt that pressed about the salary question, she  could have just told Byrnes that this was not an appropriate time to ask about salary and left it at that. There was no need for backhanded insults about an applicant needing to show “intri nsic motivation” - especially in an email which could be taken as a screenshot and distributed all over the internet, as this one was.Human resources’ departments  are often the first impression a job seeker has of a company. Give a bad impression and your company may get dragged on Twitter.This question could also have been avoided if SkipTheDishes had included more information about the position’s salary to signal what kind of applicants they were looking for. A quick line about “pay commensurate with experience” can go a long way. The CEO himself acknowledged the importance of pay when he said the company does disclose compensation and benefits packages beforehand.When should a job seeker ask about money in an interviewByrnes could have handled this better too. First off, there are better ways of conducting salary negotiations than by email. Salary talks are a crucial part of the discussion for a new job, and talking in person gives candidates the ability to judge the facial expressions and tone of the executive on the other side of the negotiation.For Byrnes’ next SkipTheDishes interview, some career coaches advised waiting until the job offer is secured to ask about money.“You don’t want to be negotiating salary until they’re at their maximum love- their maximum enthusiasm for you,” Sarah Stamboulie, a former human resources manager for Morgan Stanley and Nortel Networks said. As a job seeker, you have the most leverage when an employer tells you you’re their first choice. That’s the moment  when you press that advantage and ask for the salary you want. Its all in the name of sparking a conversation about the way robots and humans interact. For a recent art installation, Gannon trained a common industrial robot, which she named Mimus, to move spontaneously while roaming around its enclosure. Mimus appeared at the Design Museum in London through April as part of the exhibit Fear and Love: Reactions to a Complex World. Gannon is principal researcher at the Carnegie Mellon Atonaton Studio, which develops ways for humans to better communicate with machines. Mimus is the name of the bird genus that contains mockingbirds. Mimus the robot is an ABB IRB 6700 industrial species of the type usually used on automotive assembly lines to perform tasks like spot welding and material handling. The robot can hold up to 441 pounds, has a reach radius of 8.5 feet, and moves at a top speed of about 15 miles per hour. In other words she (as Gannon calls the robot) is not a machine to be trifled with. Which is exactly the point, Gannon says. There is the potential for empathy and companionship between humans and machines. Image: Atonaton As intelligent, autonomous robots become a more ubiquitous part of the built environment, its critical we design more effective ways of interacting and communicating with them, she says. The newer, smarter, autonomous robots like drones, trucks, or cars share many attributes with industrial robots: theyre large, fast, and potentially dangerous, and they dont communicate well with their human counterparts, Gannon adds. But deciding how these robots mediate our lives should not be the sole discretion of tech companies or cloistered robotics labs, she says. She programmed Mimus with a simple, agent-based behavior that generates her movement and trajectory. As the programmer, I set up the boundaries of where she can and cannot go. So, for example, she cant run onto the floor or leave her enclosure, but she decides how to move to go visit a person, Gannon says. Mimus did act toward her admirers like a relatively tame animal kept at bay by a gate at the zoo. Mimus depicts one way people could empathize with a machine and, in that way, better live harmoniously and safely with autonomous robots: via body language, Gannon says. In developing Mimus, we found a way to use the robots body language as a way to cultivate empathy between museum-goers and a piece of industrial machinery, she says. Body language is a primitive yet fluid means of communication that can broadcast an innate understanding of the behaviors, kinematics, and limitations of an unfamiliar machine. Mimus also shows the untapped potential industrial robots have for working with humans. After all, Ganon adds, industrial robots arent going anywhere. Theyve remained relatively unchanged for the past 50 years. When something responds to us with lifelike movements, even when it is clearly an inanimate object, we, as humans, cannot help but project our emotions onto it, Gannon says. But body language isnt the sole way to bridge the human-robot divide, she adds. We need many more diverse and imaginative solutions for the various ways these intelligent machines will immerse themselves in our homes, offices, and cities, Gannon says. In response to one commonly cited social fear: robots taking work from humans, Gannon says she believes in a more optimistic future, where robots expand humanity instead of replacing it. If a dispute arose, a court would have to hear evidence and decide whose version of the truth to accept. If there is a written agreement, courts will generally be obligated to uphold its terms even if they don't agree with them. What is addressed in a Catering Agreement?Catering Agreements typically address the following: the parties to the agreement; the catering service being offered; the term of agreement; and the compensation that will be provided to the Caterer. In addition, Catering Agreements may also provide specifics on: how confidential information is to be treated upon the Caterer's termination; whether there are deadlines for changing menu items or whether confirmation of the number of guests is required; and how disputes between the Customer and Caterer will be handled. Who are the parties to the Catering Agreement?The parties to the Catering agreement are the Customer and the Caterer. The Customer is the individual or business seeking the Catering while the Caterer is the individual or corporation providing the Catering. What is the difference between an Employment Contract and a Catering Agreement?A Catering Agreement is a type of Service Agreement.Catering Agreements are used to hire Caterers or independent contractors, not employees. A Catering Agreement is limited to a specific project or time period. Employment Contracts are used to hire employees. What is the difference between an employee and independent contractor?Independent contractors are individuals who provide services for a fee but are not considered to be employees because they work for themselves and do not have an employer. Examples of independent contractors include those who operate their own practice or trade in fields such as plumbing, carpentry or graphic design or in more specialized technical settings such as accounting, engineering or computer programming. The law treats employees and independent contractors differently, but it is not always easy to establish which category an individual falls into. In cases of dispute, courts will determine the appropriate category by examining a number of factors. Some factors will be considered more important than others. Examples of relevant factors are: who is providing the tools for the job; the level of skill required for the job; who controls the work and the work product; whether the hired party must provide oral/written progress reports; whether the job is performed on the business premises; the duration of the relationship between the parties; the ability to delegate or sub-contract the job of the hired party; whether the hired party has discretion over how long and when they work; whether any insurance or benefits are provided to the hired party; whether the hired party's expenses are reimbursed; whether the hired party can realize a profit or loss; whether the work is part of the regular business of the hiring party; whether the parties have a written agreement defining the status of the hired party; the method of payment; and the way the hired party is treated by taxing authorities. Is this a Master Service Agreement?No. If you need a Master Service Agreement as well as subordinate agreements, you should consult a lawyer qualified in your jurisdiction. Term of AgreementWhat is the end date of the agreement?The end date is the date when the Catering under the agreement is no longer provided or needed. What does notice mean?Notice refers to the amount of time that is provided by one party to another when they wish to end their obligations under the agreement prior to the agreed end date. The purpose of notice is to allow the Caterer to find other employment or the Customer to find a replacement Caterer. In most jurisdictions, the law does not offer independent contractors the same minimum notice protection that is typically offered to employees (unless the notice is expressly provided in the agreement). However, courts may award notice (or pay in lieu of notice) to an independent contractor if he/she can show that he/she was economically dependent on the Customer. In those circumstances, courts may impose a reasonable notice period or damages. CompensationHow should the Caterer be paid?The Caterer can be paid or compensated in many different ways. If the Caterer will be paid a certain amount (rate) for each time period, use Hourly, Weekly, Monthly or Yearly as appropriate. If the Caterer is to be paid a certain fixed amount for the complete performance under the agreement, use Fixed Amount. If the Compensation is determined by the number or type of menu items, number of guests, per plate, number of servers required for the event, or if the Compensation is several payments or involves the trade of services or goods, use Other. If you have a certain rate for the services performed together with additional remuneration, use this question for the basic rate and use the Additional Compensation question to describe the additional compensation. Which currency should I select?Select the form of currency for all monetary amounts (compensation, expenses, etc.) referred to in this agreement. What is additional compensation?Additional compensation refers to any compensation the Caterer will be paid in addition to the basic compensation specified under the question How will the Caterer be paid?. What items should be provided to the Caterer?If the Customer wishes to provide any services, tools, office space, materials, etc. to the Caterer to perform the services, then the Customer should select Yes to the question Will the Customer be providing anything to the Caterer? and then describe what he/she is providing. What does Penalties for late payment? mean?This question refers to whether the Customer will be penalized for failing to pay the Caterer on time. Select Do not specify to not mention whether there will be penalties for late payment. Select No if the Agreement will expressly state that there are no penalties for late payment. Select Yes to be able to expressly state what the penalties will be for late payment. What does Penalties imposed for non-performance of the services in a timely manner? mean?This question refers to whether the Caterer will be penalized for failing to perform the services on time. Select Do not specify to not mention whether there will be such penalties. Select No if the Agreement will expressly state that there are no such penalties. Select Yes to be able to expressly state what the penalties will be for failing to perform the services on time. What is a 1099 form?For income tax purposes, Form W-2 is used to report ordinary employee wages, salary and tips, however, self-employment earnings must also be reported. Form 1099 is used to report self-employed, service related income. Usually the payer will provide a completed Form 1099 to the payment recipient as well as to the IRS. Various kinds of income other than wages and salaries are reported using Form 1099 but the most common use of the Form 1099 is for reporting earnings as an independent contractor. Restrictive CovenantsWhat is a confidentiality clause?The confidentiality clause prevents the Caterer from using or disclosing the Customer's confidential business information to a third party. Dispute ResolutionWhat do mediation and arbitration mean?Mediation is a process where an impartial 3rd party or mediator facilitates the negotiation of a settlement between parties to a dispute. Arbitration is a process whereby parties to a dispute mutually agree to an impartial referee who hears and makes a binding decision. Both processes are superior to the court process when there is a long term relationship involved and the survival of the business relationship is desirable. These processes can be less expensive, more expedient, and more efficient than the court process. MiscellaneousWhat is contained in the standard clauses?Our standard clauses are those clauses which are most often included when creating a Catering Agreement. Some of the clauses deal with: assignment; the capacity of the independent contractor; modification of the agreement; time being of the essence; and severability of invalid or unenforceable clauses. If you don't want all these clauses in your agreement, select 'No' and you can pick and choose which clauses to include. What is meant by Corporation/Organization under the Type of Customer and Type of Service Provider fields?A Corporation is a duly registered corporate entity. An organization can be any other type of business entity such as a sole proprietorship, partnership, or a Limited Liability Company. If you are entering the agreement as the representative of a business then you would select the Corporation/Organization option. If you are acting strictly for yourself then select the Individual option. What does the Assignment clause do?The Assignment clause prevents the Caterer from transferring their rights or responsibilities to another party without the Customer's consent. What does the Capacity/Independent Contractor clause do?The Capacity/Independent contractor clause reiterates that the Caterer is hired as an independent contractor or consultant and not as an employee of the Customer. Note that disguising an employment relationship as an independent contractor in order to avoid having to pay employee benefits like holiday pay, pension, worker's compensation and income tax is illegal. A court may find that a work relationship is an employee/employer relationship if the person hired is closely supervised and directed by the hirer. An independent contractor usually provides a skilled service, is paid for a specific result, controls how the services are provided, is free to refuse additional work, and usually bears the cost of repairing faulty work. A court would take all these factors into consideration when deciding if a particular work relationship was a sham contracting arrangement. What does the Modification of Agreement clause do?The Modification of Agreement clause states that any changes to the agreement must be made by written consent of all the parties to the agreement. What does the Time of the Essence clause do?This clause provides that all dates and time limits are strictly enforced. What does the Entire Agreement clause do?The Entire Agreement clause confirms that there are no other provisions or terms outside of this agreement. What does the Severability clause do?The Severability clause declares that if the courts find that a particular clause of the agreement is invalid or unenforceable, the validity of the remaining provisions of the agreement will not be affected. What does the Return of Property clause do?The Return of Property clause states that the Caterer will return all property belonging to the Customer upon termination of the Agreement. What does the Limitation of Liability clause do?This clause allows the parties to completely absolve the Caterer in the event that any losses, damages or any other liabilities arise out of the services provided. Where this clause is selected, the contract cannot also have an indemnification clause. What does the Indemnification clause do?An Indemnification clause is where the Caterer agrees to pay back the Customer for claims made against the Customer by any third party for any damage or loss arising out of the provision of the services. Where this clause is selected, a limitation of liability clause cannot be selected. What does the Legal Expenses clause do?The Legal Expenses clause reiterates that legal costs and fees associated with any legal action will be awarded to the successful party. What does the Notice clause do?The Notice clause indicates how all notices under this agreement will be given. What does the Enurement clause do?The Enurement clause declares that any rights and responsibilities of the parties will pass on to their successors. What does the Titles/Headings clause do?The Titles/Headings clause states that the titles/headings of each section are inserted for clarification only and are not for purposes of interpretation. A common response for overworked professionals at all levels is to attempt to multitask by performing multiple activities at the same time. The problem is that multitasking doesnt work. Why Multitasking Isnt the Most Effective Approach For example, imagine that as you brush your teeth in the morning, you start thinking about the agenda for a big meeting later in the day. It doesnt take much of your brains processing power to brush your teeth, and you might be able to concentrate on the agenda while mechanically handling your morning teeth cleaning task. But what about two tasks that require more of your brains capacity? You might be talking on the phone while youre preparing breakfast. You may get both tasks done correctly, but the opportunity for mistakes due to lapses in attention is large. Chunking as an Alternative to Multitasking Chunking describes how human memory utilization works. It is important to remember this concept as we look at completing several tasks simultaneously. We are, in fact, switching between them rather than doing them at the same time (although, in the case of brushing your teeth, it may seem like they are simultaneous). Imagine you are on the phone when someone walks into your office. They ask for your advice or a quick decision on an issue. You stop listening to the person on the phone briefly, scan the note in front of you, scribble a response, and go back to the phone call. You did not do the two activities (phone call and in-person conversation) at the same time. You actually did three tasks in sequence: started the phone call, had the in-person conversation, and then resumed the phone call.
